You are a chef or other hospitality professional who has registered to use our website.

Help in using these terms

In order to help in understanding these terms, we sometimes use some defined terms, which are listed in the glossary in the appendix. This is what a defined term looks like when it is used for the first time, with the definition of the relevant term being in the glossary. The appendix also includes some other terms to help in understanding these terms.

What we do

Our website allows you to meet potential employers. You can create and post a profile, listing your qualifications and experience, and employers can review and download your profile when looking for hospitality professionals who match their hiring needs. You post, we promote, and employers search and contact you directly to discuss job opportunities that may interest you.

What these terms are for

You should please read these terms carefully before completing your registration and using the website. These terms describe: how to use our website, and what you should and should not do when doing so; what happens to your personal information that you post on the website; and what other terms apply when you use our website.  These terms form part of our contract with you covering your use of our website.

There are some Frequently Asked Questions (FAQs) on the website that answer the most common questions about how to use the website. We recommend that you read these before creating and posting your profile.

Your personal information

Our privacy policy describes how we use your personal information, who we disclose it to, and what your rights are in relation to it.  We recommend that you read this before creating and posting your profile.

Access to your personal information by employers

The principal purpose of the website is to enable you to make your personal information available to employers who are looking for hospitality professionals to fulfil potential vacancies. This means that employers who have registered with us will be able to see the personal information that you post to the website, and will be able to download it (for example, for the purposes of considering you for a position and contacting you). You will not be notified when an employer views or downloads your personal information, but it is a term of our agreement with registered employers that, once they have downloaded your personal information, they must either delete it or contact you to confirm that they have got it and what they intend to use it for. Please note that each relevant employer will be an independent controller of personal information relating to you that they download; they will be directly responsible to you, and we will not be responsible, for their use of your personal information.

Recruitment agencies

We do not permit use of the website by recruitment agencies.

Countries in which employers may be established

We only allow employers in particular countries to register and therefore have access to your personal information. A list of the relevant countries is available on the website.

Vetting of employers

While we use our reasonable endeavours to check that an employer who registers on the website is genuine and has provided us with correct information about themselves, we cannot carry out exhaustive checks and therefore cannot guarantee that all employers are genuine and that they are who they say they are. If you have any reason to believe that any employer who you know to be registered on the website (for example, because they interact with you) is not genuine or has provided us with false information, you should inform us immediately.

Registration

When you register, you will be asked to choose a user name and to create a password (these are your credentials which enable you to access the website). Guidance on user names and passwords is in the FAQs. You must keep your password secret and not disclose it to anyone else. You must notify us as soon as possible if you believe that someone else may know your password, in which case it may need to be changed in order for your access to the website to continue. Unless you have notified us that your credentials have been compromised, we will assume that any use of the website using your credentials is use by you and you may be liable accordingly.

Your profile

You must make sure that:

·        All of the information in your profile is accurate.

·        You regularly update your profile, so that it is always up to date.

·        Your profile does not include any personal information that you are not happy for anyone to have access to (see below about personal information that we recommend that you do not include).

·        Your profile does not include anything that we do not permit to be posted to the website (see below for details about content that is prohibited on the website).

You must make sure that you keep your own copy of the information that you include in your profile. We are not responsible for keeping a backup copy of your profile.

Do not include this information in your profile or CV

We require that you do not include any of the following personal information in your profile or your CV:

·         Your full name (including any names that you do not use on a day-to-day basis); for example, if your full name is Emma Jane Smith, we recommend that you only include the first name and surname that you commonly go by, such as Emma Smith.

·         Your home address; we recommend that you include only your email address to enable potential employers to contact you.

·         Your mobile or other telephone number.

This is for security reasons and to discourage any misuse of your personal information (for example, for the purposes of identity theft).

Prohibited content

The following content is prohibited on the website, so you may not post:

·        anything that is, or that might reasonably be considered to be, defamatory, offensive, indecent, or otherwise unlawful;

·        anything that is or that might reasonably be considered to be harmful to our reputation or to the reputation of anyone else (for example, your current or any previous employer) or likely to bring us or anyone else into disrepute;

·        anything that is in breach of, or which might reasonably be considered to be in breach of, any relevant law, regulation, or code of practice applicable to the content or its use for recruitment purposes; or

·        any personal information relating to anyone other than you.

If, when using the website, you encounter any content which you believe is prohibited, you should notify is immediately.

Links to other websites

We may include on our website links to other sites which we hope will be of interest to you. We do not accept any responsibility for or liability in respect of the content of those sites, the owners of which do not necessarily have any connection, commercial or otherwise, with us. Using links to gain access to such sites is entirely at your own risk.

Availability of the website

We will use our reasonable endeavours to ensure that the website is available for use, but we do not guarantee that it will be available all of the time, or in accordance with any particular service level. For example, it may be unavailable due to scheduled maintenance, to deal with any unexpected events, or for security or other reasons. We will use our reasonable endeavours to keep any interruptions to availability to a minimum.

Suspension or termination of your use of the website by us

We may, at any time, and in our absolute discretion:

·        Delete or suspend access to any information you have posted to the website;

·        Suspend your use of the website; or

·        Terminate your use of the website.

We will normally only do this for a reason (for example, because we believe that there is a security risk in relation to the website, or because you have posted some prohibited content), but we do not have to give a reason if we do not wish to do so. We will notify you by email in the event that any of the above steps are taken specifically in relation to you or your use of the website.

Termination of your use of the website by you

You can terminate your use of the website at any time, by deleting your profile; the website explains how to do this. In that case, your profile and any related personal information will be archived as set out below.

What happens to your profile and personal information on termination

If your use of the website is terminated, we will archive your profile and your personal information, and it will no longer be available via the website.

Fees for use of the website

We do not charge any fees for your use of the website.

Liability

We will not be liable to you (whether for breach of contract or for any other reason) for or in respect of any indirect, consequential, or special loss or damage. It is expected that chefs using our website in that capacity do so as individuals, for their own personal purposes, and not for the purposes of any business of theirs. Accordingly, we will not in any event be liable to you for any business losses.

Changes to these terms

We may, at any time and in our discretion, change these terms. If we do so, we will notify you by email, directing you to a copy of the new terms. You will be treated as having agreed to the new terms if you continue to use the website having been so notified.

Applicable law

The terms of our contract with you, and your use of the website, are governed by English law. Disputes will be subject to the jurisdiction of the courts in England.

You are a potential employer who has registered to use our website.

Access by employers only

Use of the website is restricted to potential employers, and (for example) recruitment consultants are not allowed to use the website. It is a breach of these terms to represent yourself as a potential employer if you are not one, and note that if you are not a potential employer you will not be entitled to access or download any personal information via the website and to do so will be a breach of these terms as well as the data protection regulations.

What we do

Access to chefs’ personal information by employers

The principal purpose of the website is to enable chefs and other hospitality professionals to make their personal information available to employers who are looking for individuals to fulfil potential vacancies. This means that employers who have registered with us will be able to see the personal information that hospitality professionals post to the website, and will be able to download it (for example, for the purposes of considering the relevant individuals for a position and contacting them accordingly). Note that, as an employer, you will have some specific obligations with regard to any personal information relating to hospitality professionals that you download, and these are dealt with separately, below (see Access to personal information, below).

Countries in which employers may be established

We only allow employers in particular countries to register and therefore have access to your personal information. A list of the relevant countries is available on the website. You should not register, or attempt to register, if you are not established and resident in one of these countries.

Registration

When you register, you will be asked to choose a user name (your email address) and to create a password (these are your credentials which enable you to access the website). Guidance on the use of user names and passwords is in the FAQs. You must keep your password secret and not disclose it to anyone else. You must notify us as soon as possible if you believe that someone else may know your password, in which case it may need to be changed in order for your access to the website to continue. Unless you have notified us that your credentials have been compromised, we will assume that any use of the website using your credentials is use by you and you may be liable accordingly.

Your subscription

Access to the website by employers is on a subscription basis (access for chefs and other hospitality professionals is free). We offer either trial subscriptions (a small fee entitles you to browse the website for a limited period and access a limited quantity of relevant personal information) or full monthly subscriptions. Monthly subscriptions continue on a rolling monthly basis until terminated in accordance with these terms (see Suspension or termination of your use of the website below).

Access to personal information

The website allows employers with subscriptions to:

·        Browse the profiles of chefs and other hospitality professionals who have registered on the website.

·        Where an individual has uploaded a CV, review and download a copy of the CV.

·        Contact relevant individuals via the website.

While individuals will not be notified by us when you view or download their personal information, it is a requirement of the data protection regulations that, once you have downloaded an individual’s personal information (including a CV), you must either delete it or contact the relevant individual to confirm that you have got it, what you intend to use it for, and how long you intend to keep it. Please note that you will be an independent controller of personal information relating to individuals that you download; you will be directly responsible to each relevant individual, and to the Information Commissioner, for your use of the personal information concerned. Your use of relevant personal information is governed by the data sharing agreement set out below, and breach by you of that agreement will be a breach of our contract with you regarding your use of the website, and (without affecting any other remedy that may apply) in that event your use of the website may be terminated immediately and without advance notice to you.

Data sharing agreement

Your access to, and use of, personal data relating to chefs and other relevant individuals who post their personal information on the website is subject to the following terms:

·        You may only use the personal data for the purposes of the potential recruitment by you of the relevant individual, or for considering the individual for such recruitment.

·        You may only use the personal data on your own behalf, and not on behalf of anyone else.

·        You must keep the personal data confidential, and may not disclose it to anyone else.

·        If you download any personal data (for example, in the form of a CV), you must within 7 days of doing so either delete the personal data that you have downloaded, or notify the relevant individual that you have got it, and what you intend to use it for.

·        You must have a privacy policy which describes how you will use personal data relating to potential employees (such as individuals who post their personal information on the website), and that privacy policy must be easily accessible to individuals whose personal information you process (for example, via your website).

·        You must otherwise comply at all times with the data protection regulations in relation to your processing of personal data relating to chefs that you access via the website.

Reasonable use of the website by you

Our website is subject to a reasonable use restriction, which means that for any month you subscribe:

·        You may not access the profile or download the CV of, or contact via the website, more than [100] individuals in total over the month.

·        You must use the website in a reasonable manner, consistent with an employer looking for individuals to fulfil roles that you currently have available.

Your profile

When you register as an employer on the website, you must complete a profile so that other users of the website can see who you are, and find out more information about you. You must make sure that:

·        All of the information in your profile is accurate.

·        You regularly update your profile, so that it is always up to date.

·        Your profile does not include any personal information that you are not happy for anyone to have access to.

·        Your profile does not include anything that we do not permit to be posted to the website (see below for details about content that is prohibited on the website).

You must make sure that you keep your own copy of the information that you include in your profile. We are not responsible for keeping a backup copy of your profile.

·        Delete or suspend access to any information you have posted to the website;

·        Suspend your use of the website; or

·        Terminate your use of the website.

We will notify you by email in the event that any of the above steps are taken specifically in relation to you or your use of the website. If we terminate your use of the website, then if the termination is other than for a good reason (which includes the specific reasons for termination described above), then we will refund the proportion of your monthly subscription that relates to the remainder of the current month after the date of termination. We will archive your profile and your personal information, and it will no longer be available via the website.

Fees for use of the website

Your subscription fee will be as agreed with you at the time you subscribe, and will be due monthly in advance at the beginning of each relevant period of a month. Payment will be by card or direct debit, as arranged when you subscribe. We may increase the subscription fee at any time by notifying you not less than one month prior to the increase taking effect, and it will be up to you to terminate your subscription before the increase takes effect if you do not wish to pay the increased fee.

Liability

We will not be liable to you (whether for breach of contract or for any other reason) for or in respect of loss of profits or revenue, any loss of or damage to software or data, or any indirect, consequential, or special loss or damage.

Changes to these terms

We may, at any time and in our discretion, change these terms. If we do so, we will notify you by email, directing you to a copy of the new terms. You will be treated as having agreed to the new terms if you continue to use the website having been so notified.

Applicable law

The terms of our contract with you, and your use of the website, are governed by English law. Disputes will be subject to the jurisdiction of the courts in England.
